Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and MNM Ventures, LLC (organized under the laws of Wyoming and Louisiana), operating the BetterFPS service. BetterFPS is a wholly owned subsidiary brand of MNM Ventures, LLC. References to "we," "us," or "BetterFPS" refer to MNM Ventures, LLC.

By using betterfps.com or any associated subdomain (collectively the "Service"), you accept these Terms. If you don't agree, don't use the Service.

BetterFPS is a web service that takes hardware and game inputs you provide and uses AI to generate ranked recommendations for in-game, driver, and Windows settings intended to improve PC game framerate. The recommendations are advisory; you implement them yourself.

We are not affiliated with, endorsed by, or sponsored by NVIDIA, AMD, Intel, Microsoft, Activision, Epic Games, Respawn, Riot Games, or any other game studio or hardware manufacturer named on the Service. Game and product names are used for descriptive purposes only and remain trademarks of their respective owners.

You can use the free playbook generator without an account. Some features (saving playbooks, subscribing to Pro) require you to sign in. By creating an account you agree that:

• The information you provide (or that your OAuth provider shares with us) is accurate.
• You're responsible for activity under your account.
• You'll keep your sign-in method secure.
• You'll notify us promptly of any unauthorized access.
• Each account is for a single individual; you won't share credentials.

We may suspend or terminate accounts that violate these Terms or abuse the Service.

You agree not to:

• Use automated tools to scrape, mirror, or bulk-download the Service beyond reasonable rate limits.
• Attempt to extract our system prompts, models, or proprietary recommendation logic.
• Resell, sublicense, or repackage Pro features for other users without written permission.
• Use the Service to harass, defraud, or harm others — including by abusing recommendations to circumvent game anti-cheat systems.
• Submit content that is unlawful, infringing, or that you don't have the right to submit.
• Probe, scan, or test the vulnerability of our systems without authorization.

Pro plans

Pro subscriptions are offered on a monthly ($7.99/mo) or annual ($59/yr) recurring basis. Charges renew automatically at the end of each billing period via the payment method on file unless canceled. You authorize Stripe to charge that payment method on our behalf.

Lifetime plan

The $149 Lifetime plan is a one-time purchase that grants Pro features for the operating life of the BetterFPS Service. It does not transfer between accounts and is non-refundable after the 14-day window described below. The Lifetime plan is offered as a limited launch promotion and may be retired once the announced cap is reached.

Cancellation

You can cancel a recurring subscription at any time through the customer billing portal accessible from your dashboard. Cancellation takes effect at the end of your current billing period; you keep Pro access until that date.

Refunds

We offer a no-questions-asked refund within 14 days of any charge (including Lifetime). Email support@betterfps.com.

Price changes

We may change subscription pricing for new sign-ups at any time. Existing subscribers will be given at least 30 days' notice via email before any price change applies to their plan, with the opportunity to cancel before the new price takes effect.

Taxes

Listed prices do not include applicable sales taxes or VAT, which may be added at checkout based on your location.

BetterFPS participates in the Amazon Associates program. When the AI suggests a hardware upgrade, we may display a link to Amazon with our affiliate tag. If you click and purchase, we receive a commission at no additional cost to you. The recommendation logic is not influenced by commission rates — the AI ranks hardware based on the user's rig and bottleneck only.

The Service is provided "as is" and "as available", without warranties of any kind. Specifically:

• We do not warrant that the AI's recommendations will produce any particular FPS gain or any gain at all. Results depend on your specific hardware, software, drivers, and game version.
• We do not warrant that the Service will be uninterrupted, error- free, or compatible with future game patches or driver releases.
• You are solely responsible for any settings you apply to your system. Some recommendations (overclock guidance, driver tweaks, BIOS-adjacent advice) carry risk of system instability, data loss, or hardware damage. We provide conservative, documented guidance, but you bear final responsibility for what you change on your own machine.
• The Service may inadvertently include game settings whose use is not permitted by a game's anti-cheat system. We aim to avoid that, but you are responsible for compliance with each game's terms of service.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, hardware damage, or game-account suspensions, even if we've been advised of the possibility of such damages.
• Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.
• Some jurisdictions don't allow these limitations — in that case, the limitations apply to the extent permitted by law.

You agree to indemnify and hold harmless MNM Ventures, LLC and its officers, directors, employees, and contractors from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of or related to: (a) your use of the Service in violation of these Terms; (b) content you submit; or (c) your violation of applicable law.

We own the Service, including the BetterFPS brand, logo, wordmark, design, source code, AI prompts, recommendation methodology, hardware database, and the curated game knowledge base. We grant you a personal, limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of the hardware information and preferences you submit. By using the Service, you grant us a license to use that information solely to deliver the Service (including generating recommendations and saving playbooks for you).

You may stop using the Service at any time. To delete your account, email support@betterfps.com with subject "Delete my account".

We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates legal risk or operational harm. We'll give reasonable notice when feasible.

Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Indemnification, Intellectual Property, Governing Law) survive.

We may update these Terms from time to time. If we make material changes, we'll notify you by email (if you have an account) or with a prominent notice on the Service before they take effect. Continued use of the Service after the change means you accept the updated Terms.

These Terms are governed by the laws of the States of Wyoming and Louisiana, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Wyoming and Louisiana, and you and we consent to personal jurisdiction there.

• Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
• Severability. If any provision is held unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision isn't a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of substantially all of our assets.
